This program is designed to explore the potential direction for mediation and ADR processes in Civil Litigation, through the next generation of First-Chair litigators, bar leaders and judges.  It is a fast-paced, interactive program involving role plays, exercises, and discussions with a limited enrollment of attendees. Refined understandings of traditional and evolved mediation concepts are also intended to lead to better client representation.

Twenty-five years ago, the Federal (and most State) Courts integrated “mediation” into the civil litigation process.  This integration was administered (and still is, to a great extent), by a generation of attorneys and judges who had little or no background with ADR practices or formal understanding of mediation processes.  “Mediation” has become a ‘generic’ term for several different types of neutral processes.  Courts have differing and sometimes conflicting definitions of “mediation.”  Much has been written and studied over the last 25-years to debate whether the legal system has evolved or devolved the mediation process to become an evaluative process, mostly involving private caucusing, as opposed to the original designs of an interest-based mediation process.

The legal profession, now, has its first generation of “First-chair” attorneys who had some level of academic training on mediation as a process in civil litigation, making the decisions on mediation and settlement.  Will this generation of litigation attorneys usher-in a new era of mediation practices and concepts, stick with a system that molded mediation concepts to fit a perceived litigation model, or develop something new?
